What is Capital Gains Tax (CGT)?

2023/24 Rates and Allowances

For the tax year 2023/24, the CGT rates and allowances are as follows:

  • The standard CGT rate for individuals is 20% for higher and additional rate taxpayers.

  • For residential property sales, higher rates may apply: 28% for higher rate taxpayers and 18% for basic rate taxpayers.
  • The annual tax-free allowance, known as the Annual Exempt Amount, is £12,300for individuals and £6,150 for most trustees.

Submission Deadlines

It is essential to be aware of the CGT submission deadlines to avoid penalties. For individuals, CGT must be reported and paid through Self Assessment if they are required to file a tax return. The deadlines for CGT submissions are as follows:

  • Tax year 2023/24: Deadline for online submission and payment is 31st January2025.

For trustees and personal representatives, different rules apply, and CGT must be reported using the Trust and Estate Tax Return.

Example of Exempt Assets

Some assets are exempt from Capital Gains Tax, meaning any gains made from their disposal are not subject to tax. Examples of exempt assets include:

  1. Main Residence: Gains made from selling your primary residence may be exempt from CGT through Private Residence Relief.
  2. Personal Belongings: Personal belongings, such as vehicles, jewelry, andartwork, are generally exempt from CGT if their value does not exceed £6,000.
  3. ISAs and Pensions: Investments held within an Individual Savings Account (ISA)or pension schemes are exempt from CGT.
  4. Gifts to Charity: If you sell or give an asset to a registered charity, you will not have to pay CGT on any gains.
